Howards reserve the right to update the Terms and Conditions at any time by displaying amended Terms and Conditions on the Website, further to which you will give your implied agreement to the amended Terms when you again make use of this Website following any amendment.

3. Conditions of use of The Website and Advice Service

3.1 Howards allows you free and unlimited access to The Website in order to allow you to consider the legal services we provide and to allow you to consider information on The Website about various legal issues.

3.2 You agree not to use this Website for any unlawful purpose including but not limited to, obtaining any information in order to seek to mislead a Court of England or Wales.

3.3 You agree not to use this website for any misleading purposes and will not post on the forum or by email any misleading or false information about yourself or others, including using false names or addresses. You further agree that you will only seek advice with regards a genuine legal issue in which you are currently involved.

3.4 The telephone advice service offered through the website will allow the user, at the discretion of the partners of Howards, free legal advice about such matters which are set out on the website and which the partners of Howards consider may be reasonably provided. Free advice will in any event be limited to such time as the partners of Howards or any of their employees consider reasonable. In the event that the partners or the employees of Howards do not feel able to provide advice on a legal matter or are unable due to time constraints or by any bad faith on the part of the user, this service may be withheld.

3.5 In making use of the telephone advice service, you agree that you will not put forward or represent any misleading or false information about yourself or others, including using false names or addresses. You further agree that you will only seek advice with regards a genuine legal issue in which you are currently involved.

3.6 Pursuant to clauses 3.3 and 3.5, the User agrees not to make use of the Advice Service for any research purpose or to collect information on behalf of any organisation or business, be it a charity, limited company, sole trader, limited liability partnership or partnership unless any enquiry made is in accordance with clause 3.5 above or unless your interest is openly and honestly declared and Howards agree to provide advice in accordance with clause 3.1.

3.7 You agree that should you act in breach of clause 3.6 you agree to pay our charges for any time spent in providing advice at the current charge out rate for the partner or employee of Solicitors who has dealt with your query.

3.8 You shall not post, email or in any way electronically transmit any material containing any virus or interfere with the operation of the Website or attempt to hack, decipher, or in any way alter any of the software, coding or information contained in the Website.

3.9 You shall not use any of the materials on this website for commercial exploitation without our prior written consent;

3.10 You agree not to use any content or any part of the website for any purpose or in any manner that may give a false or misleading impression of Howards, its partners, staff or services.

3.11 Howards wholly retain the right to determine your compliance with the above and may at its discretion refuse access to the Advice Service or to delete from the Website without prior notice to you any posting which we do not consider to comply with these terms and conditions or which we consider may be inaccurate, offensive, incorrect or misleading.

6. Instructing Howards Solicitors

6.1 Should you instruct Howards to represent you then you will be subject to separate terms and conditions of business which will form the basis of the retainer between you and Howards.

6.2 The terms and conditions of use of the website and advice service will not form a legal retainer between you and Howards

6.3 Any instructions by a user of the site to Howards Solicitors to act on their behalf are subject to a 14 day cooling off period within which the instructions may be cancelled with no liability to the Client for any costs paid or to be paid under the retainer

7. Governing law.

These Terms and Conditions are subject to the law of England and Wales and each of us hereby submits to the jurisdiction of the Courts of England and Wales.
